How do I arrange for notification?

Automatic notification—instruments made by Executive Council

If the instrument requiring notification is made at an Executive Council meeting, and was drafted by PCO, it will be notified (published) automatically on the first Friday after the Executive Council meeting at which it is made i.e. the normal pattern is that Executive Council meetings are held on Wednesdays and notifications happen 2 days later on Friday. If the instrument was not drafted by PCO, please follow the instructions for Notification—other instruments below.

 

Delayed notification—instruments made by Executive Council

If you do not want automatic notification after an instrument is made at an Executive Council meeting (i.e. you want notification to be delayed), please:

  1. Ensure the Explanatory Note accompanying the instrument clearly indicates this intention.
  1. Email notification@pco.nsw.gov.au with your request to delay no later than 1pm on the Thursday following the relevant Executive Council meeting.

Generally, we will not agree to delay notification by more than 4 weeks from the Friday after the instrument has been made. To subsequently arrange the delayed notification, you need to email notification@pco.nsw.gov.au by 1pm the day before notification is requested and include the following information:

  • full name of the instrument
  • the proposed notification date
  • if the instrument was drafted by PCO, PCO’s file reference
    • You can find this on the top of the Opinion relating to that instrument or on the bottom left hand side of the instrument itself.
  • if the instrument was not drafted by PCO, a generated (not scanned) PDF file of the instrument (as an attachment) that is formatted to A4 size and has the name of the ‘approver’ typed into the document in place of the signature
    • If the document includes graphics, please also provide a source file for the graphics.

Note—before publication, PCO will add the publication date and reference number but will make no other changes to the document.  

If you do not receive acknowledgment of your request within 24 hours, please phone 02 9321 3333 (and ask to speak to a member of the notification team).

 

Notification—other instruments (not made by Executive Council)

If the instrument is made by another person or organisation, please email notification@pco.nsw.gov.au by 5pm two days before notification is requested e.g. for notification on Friday, please email us by 5pm on Wednesday.

If you are requesting notification at any time outside the usual Friday notification schedule, the email requesting notification should come from director or executive director level.

Please include the following information in the email:

  • full name of the instrument
  • the proposed notification date
  • if the instrument was drafted by PCO, PCO’s file reference
    • You can find this on the top of the Opinion relating to that instrument or on the bottom left-hand side of the instrument itself.
  • if the instrument was not drafted by PCO, a generated (not scanned) PDF file of the instrument (as an attachment) that is formatted to A4 size and has the name of the ‘approver’ typed into the document in place of the signature
    • If the document includes graphics, please also provide a source file for the graphics.

  • a scanned copy of the signed front page (as an attachment).

Urgent or ‘special’ notification

On request, we can also notify instruments that need to be publicly available more urgently or need to meet a particular timetable e.g. those made at special Executive Council meetings or that require notification on a particular day or at a particular time.

For these requests, please phone 02 9321 3333 (and ask to speak to a member of the notification team) with details of the instrument and with as much notice as possible (preferably no later than 1pm on the day you are requesting notification).
