Division 3 Offences in relation to authorised officers
137 Offence: obstructing authorised officer
(1) A person who:(a) prevents an authorised officer from exercising a function conferred or imposed by or under this Act, or(b) hinders, obstructs, threatens or assaults an authorised officer in the exercise of such a function, or(c) without reasonable excuse, refuses or fails to comply with a requirement made or to answer a question of an authorised officer asked in accordance with this Act or the regulations, oris guilty of an offence.(d) provides an authorised officer with a document or information knowing that it is false or misleading in a material particular,Maximum penalty: 100 penalty units.(2) A person is not guilty of an offence under subsection (1) (c) unless it is established that, at the material time, the authorised officer:(a) identified himself or herself as an authorised officer, and(b) warned the person that a failure or refusal to comply with the requirement may constitute an offence.
138 Offence: impersonating authorised officer
A person who impersonates or falsely represents that the person is an authorised officer is guilty of an offence.Maximum penalty: 100 penalty units.
