299 Restriction on requiring financial assurance
The appropriate regulatory authority cannot impose a condition on a licence requiring a financial assurance to be provided unless it is satisfied that the condition is justified having regard to—(a) the degree of risk of environmental harm associated with the activities under the licence, or(b) the remediation work that may be required because of activities under the licence, or(c) the environmental record of the holder or former holder of the licence or proposed holder of the licence, or(d) any other matters prescribed by the regulations.
