Broken Hill Trades Hall Site Act of 1898 No 31



An Act to vest certain land at Broken Hill in Trustees on trust for the erection of a Trades Hall.
Preamble
Whereas by section one of the Silverton Tramway Act of 1886 certain persons were authorised to make and construct a certain tramway across the lands described in the Schedule to that Act, and to take and use so much of the said lands as might be required for the purposes of such tramway: And whereas all the rights, powers, authorities, privileges, liabilities, and obligations conferred and imposed upon the said persons by the said Act were under the provisions of section fifty-four of that Act assigned, transferred, conveyed, and released to the Silverton Tramway Company (Limited): And whereas the land described in the Schedule to this Act was at the time of the passing of the said Silverton Tramway Act Crown lands and formed part of the lands described in the Schedule to the said Silverton Tramway Act: And whereas in the year one thousand eight hundred and ninety-one the said company surrendered all its rights, title, interest, claims, and demands whatsoever to, in, or upon the piece of land described in the Schedule to this Act: And whereas on the fifteenth September, on thousand eight hundred and ninety-one, the Governor, by notice in the Gazette, dedicated the land described in the Schedule to this Act as a site for mechanics’ institute, museum, hall, or other institution for public amusement: And whereas it is expedient that the land described in the Schedule to this Act should be vested in trustees on trust for the erection of a trades hall:
Be it therefore enacted by the Queen’s Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled, and by the authority of the same, as follows:
1   Land vested in trustees for the erection thereon of a trades hall
All the estate, right, title, and interest to the land described in Schedule 1 hereto is hereby vested in a board of trustees consisting of one representative from each of the registered trades unions in the county of Yancowinna, whether affiliated or not with the Barrier Labour Federation, the said trustees to be elected from time to time under the provisions of the by-laws of each of such trades unions. Such trustees shall be trustees for the purposes of the Trades Hall, and shall be superseded from time to time by their successors as elected under such by-laws; and the said land shall be vested in the said trustees from time to time without the necessity for any conveyance or assignment whatsoever, and the trustees for the time being shall administer the provisions of this Act as though they had been the original trustees until their successors be elected, but subject to the conditions hereinafter expressed, and on trust for the erection and maintenance on the said land of a hall for the use of Trades Unions registered under the Trades Union Act 1881.

2   Trustees may make rules
The trustees may make rules for regulating the use of the land described in the Schedules to this Act and any buildings on that land, but such rules have no effect until approved by the Minister for the time being charged with the administration of Chapter 5 of the Industrial Relations Act 1996.

3   Transferred provision—vesting of land described in Schedules 2 and 3
(1)  The lands described in Schedules 2 and 3 are hereby vested in the trustees for the time being elected under this Act, upon trust for the purposes of and in connection with the trades hall aforesaid, but freed from all other trusts and dedications.
(2)  Subsection (1) re-enacts (with minor modifications) section 2 of theBroken Hill Trades Hall Site Extension Act 1915 and is a transferred provision to which section 30A of the Interpretation Act 1987 applies.

3A   Savings
(1)  Rules regulating the use of the Broken Hill Trades Hall that were in force under this Act immediately before the commencement of section 2 (as inserted by the Statute Law (Miscellaneous Provisions) Act (No 2) 2011) are taken to have been made under that section.
(2)  Rules regulating the use of the lands described in Schedules 2 and 3 and any buildings on that land that were in force under the Broken Hill Trades Hall Site Extension Act 1915 immediately before the repeal of that Act are, on that repeal, taken to have been made under section 2 (as inserted by the Statute Law (Miscellaneous Provisions) Act (No 2) 2011).

4   Name of Act
This Act may be cited as the Broken Hill Trades Hall Site Act of 1898.
Schedule 1
All that piece or parcel of land situated in the town of Willyama, parish of Picton, county of Yancowinna, in the Colony of New South Wales: Commencing at a point on the northern side of Sulphide-street; thence north by the building-line of Blend-street one hundred and ninety-eight feet; thence by a line west sixty-six feet; thence by a line south one hundred and ninety-eight feet; thence by the building-line of Sulphide-street east sixty-six feet, to the point of commencement,—and containing one rood eight perches or thereabouts.

Schedule 2
All that piece or parcel of land situate in the county of Yancowinna parish of Picton, town of Willyama, being allotment 2 of section 61, containing an area of 14½ perches or thereabouts:—Commencing on the north-eastern side of Sulphide-street at the westernmost corner of allotment 1, and bounded thence on the south-west by the north-eastern side of that street bearing north 41 degrees 39 minutes west 30 3/10 links; on the north-west by a line bearing north 48 degrees 21 minutes east 3 chains to the westernmost corner of allotment 8; on the north-east by part of the south-western boundary of that allotment bearing south 41 degrees 39 minutes east 30 3/10 links to the northernmost corner of allotment 1 aforesaid; and on the south-east by the north-western boundary of that allotment bearing south 48 degrees 21 minutes west 3 chains, to the point of commencement.

Schedule 3
All that piece or parcel of land situate in the county of Yancowinna, parish of Picton, town of Willyama, being allotment 3 of section 61, containing an area of 20¾ perches or thereabouts:—Commencing on the north-western side of Blende-street at the easternmost corner of allotment 1, and bounded thence on the south-east by the north-western side of that street bearing north 48 degrees 21 minutes east 1 chain to the southernmost corner of allotment 4; on the north-east by the south-western boundary of that allotment bearing north 41 degrees 39 minutes west 1 chain 30 3/10 links to the westernmost corner of allotment 4; on the north-west by a line bearing south 48 degrees 21 minutes west 1 chain to the northernmost corner of allotment 2; and on the south-west by the north-eastern boundaries of that allotment and of allotment 1 aforesaid bearing south 41 degrees 39 minutes east 1 chain 30 3/10 links, to the point of commencement.
