I, the Honourable Gordon Samuels AC, Governor of the State of New South Wales, with the advice of the Executive Council, and in pursuance of section 308 (1) of the Duties Act 1997, make the following Order.

Explanatory note

Section 308 (1) of the Duties Act 1997 provides that the Governor may, by order published in the Gazette, apply the whole or any specified provisions of the Act to any specified person or body (whether statutory or otherwise) that has Crown immunity. The specified person or body is subject to the requirements of the Act while the order is in force.

The object of this Order is to apply the whole of the Act to the bodies specified in the Order.

1   Name of Order

This Order is the Duties (Crown Immunity—Application of Act) Order 1998.

2   Commencement

This Order commences on 1 July 1998.

3   Application of Act to persons or bodies having Crown immunity

Pursuant to section 308 (1) of the Duties Act 1997, the whole of that Act applies to the following:

Darling Harbour Authority

Electricity Transmission Authority (TransGrid)

Landcom

Railway Services Authority

Forestry Commission trading as State Forests

State Transit Authority

Sydney Cove Redevelopment Authority

Waste Recycling and Processing Service
