412   Forfeiture offences

For the purposes of section 265 (2) of the Act, the following fisheries offences are declared to be forfeiture offences:
(a)  an offence against section 14 of the Act (Offences relating to closures),
(a1)  an offence against section 16 of the Act (Prohibited size fish),
(b)  an offence against section 17 of the Act (Bag limits—taking of fish),
(c)  an offence against section 18 of the Act (Bag limits—possession of fish),
(c1)  an offence against section 19 of the Act (Protected fish),
(c2)  an offence against section 20 of the Act (Fish and waters protected from commercial fishing),
(c3)  an offence against section 20A of the Act (Fish and waters protected from recreational fishing),
(c4)  an offence against section 21B of the Act (Trafficking in fish),
(d)  an offence against section 24 of the Act (Lawful use of nets or traps),
(e)  an offence against section 25 of the Act (Possession of illegal fishing gear),
(e1)  an offence against section 35 of the Act (Possessing fish illegally taken),
(e2)  an offence against section 65 of the Act (Contravention of plan),
(e3)  an offence against section 68 of the Act (Endorsements on licences),
(e4)  a share forfeiture offence (within the meaning of section 75 of the Act),
(e5)  an offence against section 102 of the Act (Commercial fishers required to be licensed),
(e6)  an offence against section 104 of the Act (Provisions relating to licensing of commercial fishers),
(e7)  an offence against section 108 of the Act (Provisions relating to licensing of boats),
(e8)  an offence against section 112 of the Act (Commercial fishing licence to be endorsed for restricted fishery),
(e9)  an offence against section 220ZA (Harming threatened species, populations or ecological communities),
(e10)  an offence against section 220ZB (Buying, selling or possessing threatened species),
(e11)  an offence against section 220ZC (Damage to critical habitat),
(f)  an offence against section 247 of the Act (Obstructing, impersonating etc fisheries officers),
(g)  an offence against the Fisheries Management (Aquatic Reserves) Regulation 2002,
(h)  an offence against clause 112 of this Regulation (Dynamite and explosive substances),
(i)  an offence against clause 114 of this Regulation (Use of electrical devices prohibited in all waters).
Note. A fisheries officer may seize a boat or motor vehicle that the officer has reason to believe has been used by a person engaged in commercial fishing activities for the purpose of committing a forfeiture offence (section 265 of the Act). This clause sets out the offences that are forfeiture offences.
