Explanatory note

This Regulation repeals the Periodic Detention of Prisoners (Short Description of Offences) Regulation 1993 made under the Justices Act 1902. The provisions of that Regulation are being transferred, with minor amendments, to the Periodic Detention of Prisoners Regulation 1995 made under the Periodic Detention of Prisoners Act 1981. The transfer is effected by means of the Periodic Detention of Prisoners Amendment (Penalty Notice Offences) Regulation 1998 made under the same Act.

This Regulation is made under the general regulation-making power (section 34) of the Justices Act 1902.

1 Name of Regulation

This Regulation is the Periodic Detention of Prisoners (Short Description of Offences) Repeal Regulation 1998.

2 Notes

The explanatory note does not form part of this Regulation.

3 Repeal

(1) The Periodic Detention of Prisoners (Short Description of Offences) Regulation 1993 is repealed.
(2) Any act, matter or thing that, immediately before the repeal of the Periodic Detention of Prisoners (Short Description of Offences) Regulation 1993, had effect under (or was done for the purposes of) that Regulation continues to have effect under (or is taken to have been done for the purposes of) the Periodic Detention of Prisoners Regulation 1995.
