Public Sector Employment and Management (General) Order 2011

This Order is the Public Sector Employment and Management (General) Order 2011.
(1) Except as provided by this clause, this Order commences on the day on which it is published on the NSW legislation website.(2) Clause 6 is taken to have commenced on 4 April 2011.
3 Change of name of Department of Health to Ministry of Health
(1) The name of the Department of Health is changed to the Ministry of Health.(2) A reference in any Act or statutory instrument, or any other instrument, or in any contract or agreement to the Department of Health is to be construed as a reference to the Ministry of Health.
4 Construction of reference in Housing Act 2001 relating to the management of the NSW Land and Housing Corporation
A reference in section 6 of the Housing Act 2001 to the Director-General (within the meaning of that Act) is to be construed as a reference to the Director-General of the Department of Finance and Services.
5 Construction of references in Home Building Act 1989 relating to the management of the Building Insurers’ Guarantee Corporation
(1) A reference in any of the following provisions of the Home Building Act 1989 to the Director-General (within the meaning of that Act) is to be construed as a reference to the Secretary of the Treasury:(a) section 103R,(b) section 122 (to the extent that it relates to functions under Part 6A of that Act).(2) The reference in section 103T of the Home Building Act 1989 to the Department of Fair Trading (required by previous orders to be construed as a reference to the Department of Finance and Services) is to be construed as a reference to the Treasury.
6 Construction of reference in Commission for Children and Young People Act 1998 relating to children’s services
The reference in the definition of employer in section 33 of the Commission for Children and Young People Act 1998 to the Director-General of the Department of Human Services is to be construed as a reference to the Director-General of the Department of Education and Communities.
7 Amendment of Public Sector Employment and Management Act 2002 No 43
(1) Schedule 1 Divisions of the Government Service
Omit the matter relating to the Department of Health from Columns 1 and 2 in Division 1 of Part 1.Insert instead:
Ministry of Health
Director-General of the Ministry
(2) Schedule 1, Parts 2 and 3
Omit “Director-General of the Department of Health” from the matter relating to the Cancer Institute Division, the Health Professional Councils Authority Division and the NSW Institute of Psychiatry Division, wherever occurring.Insert instead “Director-General of the Ministry of Health”.
