64 Accredited persons must report notifiable occurrences to ITSRR
(1) An accredited person must report to the ITSRR any notifiable occurrence of a kind specified in Schedule 3 that occurs on railway premises relating to a railway in respect of which the person is accredited.(2) A report of a notifiable occurrence must:(a) be made to the ITSRR within the time prescribed by the regulations or, if no time is prescribed, within the time specified by written notice given by the ITSRR to accredited persons, and(b) be made in the approved form and manner, and(c) if required by the ITSRR, be verified by statutory declaration.(3) Two or more accredited persons may make a joint report with respect to a notifiable occurrence.(4) In addition to the matters specified in Schedule 3, the ITSRR may, by written notice that expires 12 months after it is given, require an accredited person to report to the ITSRR any incident of any other kind that endangers or could endanger the safe carrying on of railway operations.(5) A person who contravenes this section, or a requirement made under this section, is guilty of an offence.Maximum penalty:
(a) in the case of a corporation (being a previous offender)—750 penalty units, or(b) in the case of a corporation (not being a previous offender)—500 penalty units, or(c) in the case of an individual (being a previous offender)—375 penalty units, or(d) in the case of an individual (not being a previous offender)—250 penalty units.(6) The Governor may, by proclamation published in the Gazette, amend or substitute Schedule 3 at any time.
