102 Imposition or variation of conditions after approval is granted
(1) The Minister may impose discretionary conditions on an approval after it has been granted, or may vary a discretionary condition, but only if the Minister:(a) has given written notice to the holder of the approval that the Minister proposes to impose such conditions or make such a variation, and(b) has given the holder of the approval a reasonable opportunity to make submissions to the Minister with respect to the proposed conditions or variation, and(c) has taken any such submissions into consideration.(2) Subsection (1) does not apply to conditions imposed on an approval, or a variation made, at the request of the holder of the approval.(3) Mandatory conditions are to be imposed on an approval whenever it becomes necessary to do so in order to give effect to a relevant management plan.(4) The Minister must cause written notice of any conditions imposed or variation made under this section to be served on the holder of the approval concerned.(5) A condition or variation referred to in subsection (4) takes effect on the day on which the notice referred to in that subsection is served on the holder of the approval or on such later day as may be specified in the notice in that regard.
