8   Applications to be dealt with by Commissioner or Tribunal

(1)  The Commissioner must deal with an application for the establishment of an apprenticeship or traineeship:
(a)  by approving the application, or
(b)  by dismissing the application, or
(c)  by referring the application to the Tribunal.
(2)  The Tribunal must deal with a referred application:
(a)  by approving the application, or
(b)  by dismissing the application.
(3)  The Commissioner may, but is not required to, deal with an application made more than 28 days after the date on which the prospective apprentice or trainee began working for the employer as an apprentice or trainee.
(4)  As soon as practicable after an application is determined, the Commissioner must notify the applicant of the determination.
