68 Tribunal may decide persons whose interests affected by a decision
(1) If it is necessary for the purposes of this or any other Act to decide whether the interests of a person are affected (or likely to be affected) by a decision, that matter is to be decided by the Tribunal.(2) If the Tribunal decides that the interests of a person are affected (or likely to be affected) by a decision, the decision of the Tribunal is conclusive and cannot be the subject of an appeal to an Appeal Panel of the Tribunal under Part 1 of Chapter 7.(3) However, if the Tribunal decides that the interests of a person are not affected (or are not likely to be affected) by a decision (other than a decision that is the subject of external appeal), the decision of the Tribunal can be the subject of an appeal to an Appeal Panel of the Tribunal under Part 1 of Chapter 7.
