Schedule 4 Savings, transitional and other provisions
(Section 63)
(1) The regulations may contain provisions of a savings or transitional nature consequent on the enactment of the following Acts:this Act
(2) Any such provision may, if the regulations so provide, take effect from the date of assent to the Act concerned or a later date.(3) To the extent to which any such provision takes effect from a date that is earlier than the date of its publication in the Gazette, the provision does not operate so as:(a) to affect, in a manner prejudicial to any person (other than the State or an authority of the State), the rights of that person existing before the date of its publication, or(b) to impose liabilities on any person (other than the State or an authority of the State) in respect of anything done or omitted to be done before the date of its publication.
Part 2 Provisions consequent on enactment of this Act
2 Saving of hunting permits under Forestry Act 1916
(1) In this clause, existing hunting permit means a hunting permit issued under section 32B of the Forestry Act 1916 that is in force on the repeal of that section by this Act.(2) An existing hunting permit continues, until it ceases to be in force, to confer the same authority for the purposes of the Forestry Act 1916 as the authority conferred by the permit under section 32B of that Act immediately before the repeal of that section by this Act.(3) An existing hunting permit is, except as provided by the regulations under this Schedule, taken to be a restricted game hunting licence granted under this Act, but only in respect of the hunting of game animals on land for which it was granted.
3 Saving of licences etc granted under NPW Act
The enactment of this Act does not affect any licence or other authority granted under the National Parks and Wildlife Act 1974.
Part 3 Provision consequent on enactment of Game and Feral Animal Control Amendment Act 2005
The amendment made to section 13 by the Game and Feral Animal Control Amendment Act 2005 extends to a fine, or an amount payable under a penalty notice, recovered after the commencement of the amendment, even if the fine was imposed, or the penalty notice was issued, before that commencement.
