54 Requirements as to citizenship or permanent residency
(1988 Act, s 39)
(1) A person is eligible to be appointed as an officer in the Public Service only if the person is:(a) an Australian citizen, or(b) a person resident in Australia whose continued presence in Australia is not subject to any limitation as to time imposed by or in accordance with law.(2) An officer who is not an Australian citizen and who ceases to satisfy or does not satisfy the requirements of subsection (1) (b) is no longer eligible to continue in employment as an officer in the Public Service and is to be dismissed from that employment by the appropriate Department Head.(3) The Commissioner may exempt a person from the operation of this section in any case the Commissioner considers appropriate.
