Section 4040 Certain persons not eligible for membership
(1) A person is not eligible to be a member of the Advisory Committee if the person:(a) is currently disqualified, or is a person whose name is currently on the list relating to disqualifications, suspensions, subjects of inquiries and defaulters kept under the rules, or(b) during the previous 10 years has been convicted in New South Wales of an offence which is punishable by imprisonment for 12 months or more, or convicted elsewhere than in New South Wales of an offence which, if committed in New South Wales, would be an offence so punishable, or(c) is an undischarged bankrupt or is taking advantage of the laws in force for the time being relating to bankruptcy, or(d) is a mentally incapacitated person.(2) A person is not eligible to be a member of the Advisory Committee for more than 4 consecutive terms of office, but there is no limit on the number of non-consecutive terms for which a person can be a member. A term of office is counted for the purposes of this subsection even if the member did not serve out the full period of that term of office.
