Section 9797 Construction of certain references

(1) In any other Act, in any instrument made under any Act or in any other instrument of any kind (enacted, made or executed whether before or after the commencement of this section), except in so far as the context or subject-matter otherwise indicates or requires:(a) a reference to the “Public Service” or the “public service” shall be read as a reference to the Public Service within the meaning of this Act, and(b) a reference to a “Public Servant” or a “public servant” shall be read as a reference to an officer or temporary employee within the meaning of this Act, and(c) a reference to a Department Head shall be read as including a reference to a person who has the functions of a Department Head.(2) (Repealed)(3) Subsection (1) does not apply to particular references specified for the purposes of this subsection by the Governor by order published in the Gazette.
