(1979 Act, s 85)
(1) An officer is guilty of a breach of discipline if the officer:(a) contravenes this Act or the regulations, or(b) engages in any misconduct, or(c) consumes or uses alcohol or drugs to excess, or(d) intentionally disobeys, or intentionally disregards, any lawful order made or given by a person having authority to make or give the order, or(e) is negligent, careless, inefficient or incompetent in the discharge of his or her duties, or(f) engages in any disgraceful or improper conduct, or(g) takes any detrimental action (within the meaning of the Protected Disclosures Act 1994) against a person that is substantially in reprisal for the person making a protected disclosure within the meaning of that Act, or(h) takes any disciplinary proceedings or disciplinary action against another officer that is substantially in reprisal for an internal disclosure made by that officer.(2) In this section, internal disclosure means a disclosure made by an officer regarding an alleged breach of discipline by another officer belonging to the same Department as that to which the officer belongs.
