131 Continuing offences
(1) Where an offence is committed by a person by reason of the
person’s failure to comply, within the period specified in a direction
given to the person under this Act or the regulations, with the requirements
specified in the direction, the offence, for the purposes of Subsection (3),
shall be deemed to continue so long as any requirement specified in the
direction remains undone, notwithstanding that the period has
elapsed.
(2) Where an offence is committed by a person by reason of the
person’s failure to comply with a requirement made by this Act or the
regulations, the offence, for the purposes of subsection (3), shall be deemed
to continue so long as that failure continues, notwithstanding that any period
within which the requirement was to be complied with has
elapsed.
(3) Where, under either subsection (1) or (2), an offence is to be
deemed to continue, the person who committed the offence commits an additional
offence against this Act on each day during which the offence is to be deemed
to continue and is liable, upon conviction for such an additional offence, to
a penalty not exceeding 100 penalty units.
