99 Advertisement or promotion of health services
(cf 1991 Act, s 10AN)
A person must not advertise or otherwise promote the provision of a health service in a manner that:(a) is false, misleading or deceptive, or(b) is likely to mislead or deceive, or(c) creates, or is likely to create, an unjustified expectation of beneficial treatment.Maximum penalty:
(a) in the case of an individual—100 penalty units for a first offence or 200 penalty units for a second or subsequent offence, or(b) in the case of a corporation—500 penalty units for a first offence or 1,000 penalty units for a second or subsequent offence.
