15 Signing of statements
(1) Any statement lodged with the Director-General under this Act
shall be deemed to be signed by a person who is required to sign the statement
if:(a) in the case of an individual—it is signed on the
person’s behalf by a person authorised in writing to so sign the
statement, or
(b) in the case of a corporation—it is signed by a director or
the chief executive officer or secretary of the
corporation.
(2) Notwithstanding any other provision of this Act where the
Director-General is satisfied that it is not practicable to obtain the
signature of a person required by this Act to sign a statement the
Director-General may accept the statement for registration without its being
signed by that person; but a person is not relieved of the requirement to sign
a statement and a statement not signed by any person is not by reason only of
its registration under this Act evidence relating to that person’s
interest in a business.
(3) Any provision of this Act that requires an application or notice
to be signed does not have effect with respect to an application or notice
that is made or lodged by means of electronic
communication.
(4) Such an application or notice must instead be authenticated as
required by the Director-General.
